Terms and Conditions
In these terms and conditions and in all contracts to which these terms and conditions apply
“The Purchaser” shall mean yourselves.
“Interior Designs (NE) Ltd shall mean the organisation.
“The materials” shall mean chipboard and melamine or solid wood veneers as, appropriate to the range of furniture ordered under this contract.
“The goods” shall mean the furniture, domestic appliances and accessories specified in the order not drawing overleaf.
“The labour” shall mean the fitting of the goods and materials and any labour such as plastering, tiling, electrics, joinery and gas specified in the drawing.
- Information of contract
1.1 Acknowledgement and acceptance of this purchase order by you signing the purchase order enclosed with it, at which time you will be bound by these terms and conditions. Each order accepted shall constitute an individual legally binding contract
between you and us. Such contract is hereafter referred to in these terms and conditions as “an order”. This order will be accepted entirely at our discretion.
1.2 These conditions should override any contrary, different or additional terms and conditions contained or referred to any proposal, estimate, prior order forms or other documents from us. No addition, alternative, substitution or waiver of these
terms and conditions will be valid unless expressly accepted in writing by us or a person authorised to sign on our behalf.
1.3 Nothing in these terms and conditions shall prejudice any condition or warranty expressed or implied, or any legal remedy to which we may be entitled in relation to the goods/and the work the subject of this order.
1.4 Theses terms and conditions shall be constructed in accordance with the laws of England and shall be subject to the exclusive jurisdiction of the English Courts. - Our Responsibility
2.1 We will ensure that all materials supplied comply with safe building practices and are free from defects and that any work carried out is carried out with reasonable care and skill and to a reasonable standard.
2.2 Before starting any work we may carry out an inspection to make sure that all work quoted is appropriate and predictable.
2.3 If after our inspection any further work is necessary either because of alterations in design, specification or otherwise and this causes an increase in costs we will send you details of the extra costs and will only proceed with the works once your
written acceptance has been received.
2.4 We will make good any damage caused whilst carrying out the work.
2.5 We will dispose of any associated rubbish in the removal of existing units unless stated on the order, with the exclusion of fridges and freezers, beds, mattresses and carpets.
2.6 We will ensure that the installation of the goods be completed within a reasonable timescale. Time shall not be of the essence in respect of the completion of the installation by Interior Designs (NE) Ltd. Fitters may need to return to complete any
minor finishing jobs. Any minor adjustments thereafter shall not be deemed sufficient reason for withholding payment of any part of the sum outstanding , unless agreed by Interior Designs (NE) Ltd. - Your Responsibility
3.1 You will permit us during normal working hours to carry out an inspection and thereafter to undertake the works according to the programme set out in the order.
3.2 You will remove all items necessary to allow us to commence the works and cover and protect all fixtures and fittings which cannot be removed, including but not limited to carpets, radiators, wiring, electrical fitting and plumbing fittings.
Interior designs are not responsible for damage of any items not removed from the room or passageways in which we would need access.
3.3 When having a fitted bedroom please make sure ALL freestanding furniture is removed prior to the fitter’s arrival. If this is not possible, please contact Interior Designs (NE) Ltd to inform them of this. Please note it may be necessary for fitters to stand
beds up on end if working space is restricted, if you do not want this done, we advise you remove the bed from the room yourself.
3.4 You will ensure that any items you do not want disposed of (e.g.) oven, fridge etc. are included on the confirmation order paperwork sent to you prior to installation and if they are not then you must advise us in writing of the items to be kept at
least 7 days before commencement of works.
3.5 You will obtain all permissions and consents, (including if necessary, planning permission for landlords, local authorities and others, which are required before the work can commence.
3.6 You will be responsible for the organisation and payment for any necessary electrical works required to ensure that the installation meets with the Part P Regulations.
3.7 Where you are required to provide us with measurements or other information such measurements or information must be correct. If we rely on the measurements or information given when preparing our proposal and such measurements or
information are incorrect we reserve the right to increase the price to make good any errors or additional works required as a result.
3.8 Where a wall or ceiling is being plastered all visible wallpaper must be removed before the arrival of Interior Designs (NE) Ltd, as this is not a service we offer. - Type(s) of Work Undertaken
4.1 We will carry out all types of work associated with the order using employed fitters by Interior Designs (NE) Ltd and sub-contractors when needed. - Payment
5.1 On acceptance of the order in accordance with paragraph 1.1 the deposit of 25% specified in the order shall be payable. The balance of the order price is due in two instalments of 65% five working days prior to commencement of works and
10% on completions of works. We warrant that we have good title to the goods and will transfer such title as we have in the goods to you pursuant to paragraph 5.4 below.
5.2 If you fail to pay the order price within 7 days of it becoming due interest shall be chargeable on the outstanding amounts at a monthly rate of 2%. Any minor adjustments which may or may not be necessary thereafter shall not be considered reason
for withholding payment or any part of any sum outstanding.
5.3 Should you cancel your order after the period specified in condition 6 below your deposit may not be refunded.
5.4 Title to the goods comprised in the order shall not pass to you until you have paid the full price, although we reserve the right to sue for the price once payment becomes due notwithstanding that title may not have passed. - Cancellations
6.1 The purchasers deposit is not refundable if the order is cancelled by the purchaser after Interior Designs (NE) Ltd has ordered any item specifically related to the purchaser’s order or if Interior Designs (NE) Ltd has incurred any costs in preparing the order.
6.2 If there have been no costs incurred by Interior Designs (NE) Ltd as set out in paragraph 6.1 the purchaser may cancel the order in writing within 7 days of the order date and the deposit will be refunded in full.
- Force Majeure
7.1 We shall not be liable for delay or failure to perform any of our obligations under this order if the delay or failure is caused by any circumstances beyond our reasonable control.
7.2 The purposes of this condition “force majeure” shall include, but not be limited to acts of God, war, terrorism, civil disorder, industrial dispute, pandemics or explosions.
7.3 Upon the happening of a “force majeure” event we shall be entitled to a reasonable extension of time for the performance of our obligations. - Guarantees
8.1 We grant the following guarantee(s). Interior Designs (NE) Ltd guarantee the labour provided for a period of 5 years from the date of completion of works. The guarantee does not cover any faults that have been caused by misuse or damage that could have
been avoided by the purchaser.
8.2 Exclusion: – All appliances (sinks, tap, hob, etc.) are covered by individual manufacturer’s guarantees and not by Interior Designs (NE) Ltd, please refer to individual literature supplied with appliances for details. We recommend you take note of the serial
numbers before the appliances are tted. Vinyl doors come with a 12-month manufacturer’s guarantee. Solid wood and painted doors come with a range of manufacturers guarantees from 12 months to 5 years, this can be conrmed from the manufacturer. - Exclusions
9.1 We do not exclude liability for death or personal injury, however we shall not be liable for any direct loss or damage suffered by you howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise in excess of Interior Designs (NE) Ltd.
9.2 We shall not under any circumstances be liable for any indirect or consequential loss howsoever caused whether by negligence, breach of contract, misrepresentation or otherwise.
9.3 We or our insurers shall not be liable or investigate any claim for loss unless you have given written notice to us within seven days of the occurrence and given us or our insurers every facility to investigate such occurrence. - Specification
10.1 All goods, materials and labour supplied by us shall be in accordance with our current price list as published from time to time and further specications or descriptions expressly listed or set out on the order. - Acceptance
11.1 You will be deemed to have accepted all goods upon their delivery by us to the address specied in the order.
11.2 We must be informed in writing within 7 days of acceptance of the order of any changes, alterations, reductions or cancellations, we reserve the right to retain any deposits or change in full for any goods supplied or fabricated where cancellation in not made
within the period specied. - Delivery and Risk
12.1 Unless otherwise stated in the order, the price quoted includes delivery to the address in the order.
12.2 Whereas we will try to ensure compliance with any delivery times and dates given, such times and dates are an estimate only. We will not be responsible for any loss whatsoever arising from or consequential upon delay or commencement of works.
12.3 Risk in the goods shall pass to you the purchaser upon delivery.
12.4 We will not be held responsible for any damage or loss caused to old units, appliances, wall and door fixings that you maybe wish to be kept; we will remove these with as much care as possible but can make no guarantees that damage will not occur.
Should you require a guarantee that these will not be damaged may we suggest you arrange for the removal yourself. - Other
13.1 Vat will be charged at the rate appertaining on the day of delivery.
13.2 The Drawing is the order – only units and accessories specified on the confirmation order will be supplied.
13.3 Dimensions of units are approximate and may be altered at the discretion of the factory.
13.4 In the case of a new property the purchaser should inform Interior Designs (NE) Ltd if power will not be available.
13.5 There will be a join in any length of melamine over 2500mm.
13.6 Stone / Granite worktops come in different lengths per material ranging from 2.2m – 3.2m, where needed there may be a join in worktops larger than the slab available, this will be decided upon by the manufacturer on templating. 13.7 On front frame
bedrooms under normal construction, doors, backs and non-stopping side panels are not included in the bedroom order, unless otherwise stated on the confirmation order.
13.8 Any computerised drawings and front elevations are visual aids only and are NOT to scale.
13.9 Colour on carcasses and frameworks may differ from doors as these are manufactured in a different material. We always use the recommend board match from each door manufacturer or will purchase matching board from door supplier if no board match available.
13.10 Make sure enough time is allowed for Interior Designs (NE) Ltd to complete the fitting before decorators and carpet fitters are booked as Interior Designs (NE) Ltd cannot be responsible if the job runs over and they have to be cancelled or re arranged.
13.11 Occasionally we come across material which could contain asbestos. Interior Designs (NE) Ltd are trained to spot asbestos and if they believe it may be present within the room they are working a test will be carried out. If a positive result is recorded the
asbestos MUST be removed by a certified company, Interior Designs (NE) Ltd can arrange this to be removed at an extra charge. Please note that if asbestos is found we cannot continue works until it is removed.
13.12 On your fitted kitchen should you wish to fit or purchase your own flooring separate from Interior Designs (NE) Ltd order, we will leave o any plinths needed for a better nish, however a return charge of £100 will be charged to yourself for re-fitted of the
plinths. Any flooring purchased and supplied by Interior Designs (NE) Ltd will incur no charge for re-fitting of the plinths. - Complaints
14.1 On completion of works we recommend you check over all tted furniture and report and faults/issues within 7 days, issues reported after this time may not be able to be rectied.
